CO-OWNERSHIP IN MOROCCO
The decree of 23 January 2025 sets accounting rules for syndicates of co-owners. Article 2 applies it from the accounting year following publication: 2026 for a January–December year. The required statement models depend on the year’s revenue, not the number of apartments.
Ask your manager for the accounting year used, individual contribution records, cash position and statements appropriate to the syndicate’s revenue level.

The covered acts transferring ownership or real rights in co-owned property require an authentic deed, on pain of nullity; the text exempts the State’s private domain.

Check the allocation in the regulation: undivided share for conservation and management, utility for shared services and equipment. Identical charges for every unit should not be assumed.
The legal notice period is at least 15 days, with location, date, time and agenda. Prepare your questions and consult the announced documents before voting.

Define tasks, follow-up, fees and takeover arrangements before making a commitment.
The manager applies the regulation, keeps accounts, collects contributions against receipts and retains documents. They report to the general meeting. Contractual tasks should be specified in the mandate.
Review the budget and allocation alongside the regulation. The law distinguishes conservation and management costs allocated by undivided share, and services or equipment by their utility to the unit. Ask for the calculation and supporting documents.
Prepare the documents, put the issue on the agenda and follow the appointment or removal rules. After the decision, arrange a documented handover of accounts, archives, contracts and funds. Avoid relying on an oral promise alone.
First check the debt, due dates, payments received and decisions supporting the charges. Use documented steps and the applicable legal procedures. For litigation, have the file reviewed by a legal professional.
A proposal should reflect the number of units, equipment, document condition and management scope. Compare included tasks, extra services and reporting arrangements as well as the fee amount.
